These Terms of Service ("Terms") govern your use of the Keel Analytics mobile application and related services (collectively, the "Service") operated by Keel Analytics LLC ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Keel Analytics, you represent that you meet these requirements.
2. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only for its intended purpose: viewing and analyzing your own advertising and e-commerce data. You may not:
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to access data you are not authorized to view.
- Attempt to interfere with or disrupt the Service's infrastructure.
- Use automated scripts, bots, or scrapers to access the Service.
- Resell, sublicense, or redistribute access to the Service without our written permission.
4. Third-Party Platform Connections
Keel Analytics connects to third-party platforms (Shopify, Meta, Google, TikTok, Snapchat) using OAuth authentication. By connecting a platform, you:
- Authorize us to access and retrieve your analytics data from that platform.
- Confirm that you have the right to access the data in the connected accounts.
- Acknowledge that the availability and accuracy of third-party data is subject to those platforms' own terms, APIs, and uptime.
We are not responsible for any changes, outages, or data discrepancies caused by third-party platforms.
5. Data and Privacy
Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy.
6. Intellectual Property
The Service, including its design, code, graphics, and content, is owned by Keel Analytics LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or business purposes.
7. Service Availability
We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable for any downtime or service interruptions.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The data displayed in the app is 100% accurate or complete.
- The Service will meet your specific requirements.
- The Service will be available without interruption.
9. Limitation of Liability
To the maximum extent permitted by law, Keel Analytics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
10. Termination
You may stop using the Service and delete your account at any time from the app's Settings. We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Sheridan County, Wyoming.
